Terms of Service

These terms are an agreement between you (the business subscribing to the service, "you") and Della Desk ("Della Desk," "we," "us"). By creating an account or using the service you agree to them.

1. The service

Della Desk provides an AI-powered phone receptionist: a phone number (or connection to your existing number) answered by an automated agent that greets callers, answers questions from the information you provide, takes messages, and books appointments. The service also includes a web dashboard, notifications, and related features that may change over time.

2. Your account

You must provide accurate information, keep your login credentials secure, and be at least 18. You are responsible for activity under your account. One account per business unless we agree otherwise.

4. Your content and data

You own your business information, call recordings, transcripts, messages, and bookings. You grant us the limited rights needed to operate the service (store, process, transmit, and display that content to you and your callers). Our handling of personal information is described in the Privacy Policy. You are responsible for the accuracy of the information you give the receptionist and for having the right to share any content you upload.

5. Call recording compliance

Call recording notices are enabled by default. Many jurisdictions (including Florida) require all-party consent to record calls. You are responsible for keeping recording notices enabled where required and for your own compliance with recording and wiretap laws in the places your callers are located.

Phone numbers provisioned through Della Desk are licensed for your use during your subscription. Where supported, you may port your number out when you leave; contact support and we will cooperate with the port.

8. AI disclaimer

The receptionist is an automated AI system. It is designed to follow the information and rules you configure, but AI output can occasionally be inaccurate or incomplete. You should review important messages and bookings in your dashboard and not rely on the service for medical, legal, financial, or safety-critical advice or dispatch.

9. Availability and support

We aim for high availability but the service is provided "as is" and "as available," without warranties of any kind, express or implied. Telephony depends on third-party carriers and providers we do not control.

10. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and our total liability for any claim arising out of the service is limited to the amounts you paid us in the 12 months before the claim arose.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your content, your use of the service in violation of these terms, or your violation of law (including recording-consent and telemarketing laws).

12. Termination

You may close your account at any time (Settings → Delete account). We may suspend or terminate accounts that violate these terms, create legal risk, or remain unpaid after notice. On termination we delete your data as described in the Privacy Policy.

13. Changes to these terms

We may update these terms; material changes will be announced by email or in the dashboard at least 14 days before they take effect. Continued use after the effective date is acceptance.

14. Governing law and disputes

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida, and each party consents to their jurisdiction.
